Please read these Terms and Conditions carefully before using the Niche Trading website. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Interpretation and Definitions

Interpretation

Words with initial capital letters have the meanings defined below. These definitions apply whether terms appear in singular or plural form.

Definitions

• Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other voting securities.
• Account means a unique account created for you to access our Service or parts of our Service.

• Country refers to: Qatar.
• Content means text, images, or other information posted, uploaded, or linked through the Service.
• Device means any device that can access the Service, such as a computer, mobile phone, or tablet.
• Goods refers to the items offered for sale on the Service.
• Order means a request by You to purchase Goods from Us.
• Service refers to the Website.
• Terms and Conditions (also referred to as "Terms") means this agreement between You and the Company regarding use of the Service.
• Third-Party Social Media Service means any service or content provided by a third party that may be displayed or made available through the Service.
• Website refers to Niche Trading, accessible from https://www.niche-trading.com.
• You means the individual accessing or using the Service, or the company or other legal entity on whose behalf that individual is acting.

2. Acknowledgment

These Terms govern the use of this Service and constitute the agreement between You and the Company. They set out the rights and obligations of all users. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part, You may not access the Service. You represent that You are at least 18 years of age. The Company does not permit those under 18 to use the Service.

Your use of the Service is also subject to Our Privacy Policy, which describes how We collect and process Your personal information. Please read the Privacy Policy carefully before using Our Service.

3. Placing Orders for Goods

By placing an Order, You warrant that You are legally capable of entering into binding contracts and that all information You provide is true, accurate, and complete.

Your Information

When placing an Order, You may be asked to supply information including Your name, email address, phone number, delivery address, and payment details. You represent and warrant that You have the legal right to use any payment method provided.

Order Cancellation by the Company

We reserve the right to refuse or cancel Your Order at any time for reasons including but not limited to: goods unavailability, pricing or description errors, errors in Your Order, or suspected fraud or unauthorized transaction. You will be notified and any payment received will be refunded.

Your Cancellation Rights

You may cancel an Order before it is dispatched by contacting us via WhatsApp or email. Once dispatched, please refer to Our Returns & Exchanges Policy. Goods that are returned must be in the same condition as received — unopened, unused, and in original packaging. The following Goods are not eligible for return or cancellation:

• Goods made to Your specification or clearly personalized.
• Goods that deteriorate rapidly or have passed their expiry date.
• Opened beauty, skincare, haircare, or hygiene products (for health protection reasons).
• Goods which, after delivery, are inseparably mixed with other items.
• Items marked as final sale or discounted more than 30%.
• Gift cards and promotional vouchers.

Eligible refunds will be processed within 5–7 business days of receiving the returned Goods, using the original payment method. For cash-on-delivery orders, refunds will be issued as store credit.

4. Availability, Errors, and Inaccuracies

We continuously update our Goods listings. However, pricing, product images, descriptions, or availability may occasionally be inaccurate or subject to delays in updating. We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice, and to change or update information as required.

5. Pricing Policy

All prices are listed in Qatari Riyals (QAR) unless otherwise stated. The Company reserves the right to revise prices at any time before accepting an Order. In the event of a material price error, We will notify You and You will have the right to cancel Your Order before dispatch.

Prices may be subject to revision after Order acceptance in circumstances beyond Our reasonable control, including government action, import duties, exchange rate fluctuations, or increased logistics costs. In such cases, You will be informed and may cancel Your Order.

6. Payments

Payment is required in full at the time of purchase (or upon delivery for cash-on-delivery orders). Accepted payment methods include Visa, Mastercard, American Express, and other methods displayed at checkout. Cash on delivery (COD) is available for orders within Qatar.

Payment cards are subject to validation and authorization by your card issuer. If authorization is not received, We will not be liable for any delay or non-delivery. We do not store your full card details — all card transactions are processed by our secure third-party payment processors who comply with PCI-DSS standards.

7. Delivery

We deliver across Qatar. Estimated delivery timeframes are as stated on our Shipping & Delivery page. Delivery times are estimates and not guaranteed. We are not liable for delays caused by events outside Our reasonable control, including courier delays, customs, or force majeure events. Risk of loss or damage passes to You upon delivery.

8. Product Authenticity

Niche Trading sells authentic, original products sourced through legitimate supply chains. We do not sell counterfeit goods. However, We make no claim of being the sole, exclusive, or official distributor of any brand unless otherwise expressly confirmed in writing by the relevant brand owner. Product descriptions, certifications, and brand claims on the Website reflect publicly available information and our reasonable belief in their accuracy.

9. User Accounts

When You create an Account, You must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of Your password and for all activities that occur under Your account. You must notify Us immediately of any unauthorized use of Your account. We may terminate accounts that violate these Terms or contain inaccurate information.

10. User-Generated Content

If the Service allows You to post content, You are responsible for ensuring that your content is lawful, accurate, and does not infringe on the rights of third parties. By posting content, You grant Us a non-exclusive license to use, display, and distribute that content through the Service. We reserve the right to remove any content that violates these Terms or applicable law.

You may not post content that is unlawful, defamatory, discriminatory, obscene, threatening, spam, malicious software, or that infringes intellectual property rights.

11. Intellectual Property

The Website and its original content, features, and functionality are owned by Niche Trading and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without Our express written permission. Product names, brand names, and logos displayed on the Website are the property of their respective owners.

12. Copyright Infringement

We respect the intellectual property rights of others. If You believe that content on the Service infringes Your copyright, please notify Us in writing at info@niche-trading.com with: (a) a description of the copyrighted work; (b) the URL of the infringing content; (c) Your contact details; and (d) a statement that You have a good faith belief that the use is unauthorized. We will take appropriate action upon receipt of a valid notice.

13. Links to Third-Party Websites

Our Service may contain links to third-party websites. The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites. We strongly advise You to review the terms and privacy policies of any third-party sites You visit.

14. Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, if You breach these Terms. Upon termination, Your right to use the Service ceases immediately.

15. Limitation of Liability

To the maximum extent permitted by applicable law in Qatar, the Company's total liability to You for any claims arising from or related to the use of this Service shall not exceed the amount actually paid by You for the relevant Order, or QAR 500 if no purchase was made.

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or personal injury, arising from or related to Your use of the Service, even if We have been advised of the possibility of such damages.

16. "AS IS" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by Qatari law, We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting the Company. If informal resolution is not possible, disputes shall be subject to the exclusive jurisdiction of the competent courts of Qatar.

18. Severability and Waiver

Severability: If any provision of these Terms is held to be unenforceable or invalid under Qatari law, that provision will be modified to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.

Waiver: Failure to exercise a right or enforce an obligation under these Terms shall not constitute a waiver of that right or obligation for future purposes.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before new terms take effect. By continuing to use the Service after revisions become effective, You agree to be bound by the updated Terms.
